Terms and Policy

1. About Mooss

Mooss is an AI-powered personal styling assistant operated by Modascope Inc. (Delaware C-Corporation). We assist users in organizing their wardrobe and generating personalized outfit and visual styling inspiration. This Agreement applies to all users ("you," "your") who access or use our mobile application and related services (collectively, the "Service").

2. Eligibility

You must be at least 13 years old to use Mooss. If you are between 13 and 18, you confirm that you have obtained parental or guardian consent. By using Mooss, you represent that you have the legal capacity to enter into this Agreement in your jurisdiction.

3. Account Registration

To access the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your login credentials.
• Not share your account with any third party.
• Notify us immediately if you suspect unauthorized access. Mooss reserves the right to suspend or terminate accounts that violate these terms or applicable laws.

4. Your Wardrobe & Image Processing

To provide our digital wardrobe and styling features, you may upload photographs that contain clothing items, which may incidentally include backgrounds or personal spaces.

By uploading any photo, you confirm that:

• You own the content or have obtained permission from the copyright holder.
• Your photos do not contain nudity, obscene material, hateful symbols, or violate any third-party rights.

How Mooss Processes Your Photos: Mooss processes images solely for the following purposes:

• Identifying garments and accessories.
• Converting images into studio-quality flat-lay assets for your digital wardrobe.
• Generating AI-driven styling and outfit recommendations.
• No Facial Recognition — Mooss does not use uploaded photos for facial recognition, identity verification, or advertising. Facial features and unrelated personal information are automatically ignored, cropped, or excluded during processing.
• Data Security — We employ industry-standard encryption to protect your photos during transmission and storage.
• No Sale of Data — Mooss will never sell your personal photos to third parties.
• Service Providers — We may use trusted third-party service providers, including cloud infrastructure, image-processing, artificial intelligence, analytics, authentication, and other technology providers, to process information on our behalf as necessary to operate and improve the Service. These providers are authorized to process information only as necessary to provide the services requested by Mooss and are subject to appropriate contractual or confidentiality obligations.
• AI Processing — Some uploaded images and related information may be processed by third-party AI or cloud service providers in order to provide image recognition, image processing, styling recommendations, and related functionality.
• Your Control — You may delete any photo from your wardrobe at any time. When deleted, the photo is removed from our active servers, with residual copies in backup systems typically purged within 30 days.
• Account and Data Deletion — You may also request deletion of your account and associated personal data through available in-app controls or by contacting us at info@modascope.app. Certain information may be retained where necessary to comply with legal obligations, resolve disputes, enforce our agreements, or maintain legitimate business records.

5. AI Styling Content

• Recommendation Nature: Recommendations are generated by AI algorithms and serve as creative visual inspiration; they do not guarantee aesthetic satisfaction. You retain the final judgment on all styling choices.
• Visual Content: Recommendations consist of outfit imagery and styling ideas to help you organize and inspire your digital wardrobe.

6. Data Usage & AI Training

• No AI Training on Personal Data: We do not use your personal data, uploaded photos, or personal content to train our artificial intelligence models. All user content is processed strictly and temporarily to provide styling and wardrobe services to you and is never used for machine learning improvements or model training.

We may, however, use technical, usage, performance, and diagnostic information to maintain, secure, troubleshoot, measure, and improve the Service. Such information may include crash reports, performance information, device or application information, and other technical data generated through your use of the Service.

We do not use your personal photos for advertising or facial recognition.

7. Intellectual Property

• Your Content: You retain ownership of all uploaded content. By uploading any content, you grant Mooss a non-exclusive, worldwide, royalty-free license to host, analyze, process, modify, and display your content solely as necessary to provide, maintain, and improve the Service. This license includes the right for our service providers to process your content on our behalf as necessary to provide the Service.
• Our IP: All AI models, style heuristics, algorithms, designs, and the Mooss brand are owned by Modascope Inc. You may not reverse-engineer, scrape, or commercially exploit these assets.

8. Prohibited Conduct

You agree not to:

• Infringe third-party intellectual property or privacy rights.
• Use the Service for illegal, harassing, or harmful purposes.
• Circumvent security measures or interfere with the Service.
• Scrape or extract data for commercial use.
• Upload content that you do not have the right to use or provide to Mooss.
• Attempt to gain unauthorized access to the Service, other users' accounts, systems, or data.
• Use the Service to upload or process unlawful, fraudulent, or malicious content.

9. Termination

Mooss may suspend your access if you breach this Agreement. You may delete your account and data at any time via the app settings. Upon termination, we are not obligated to retain your data unless required by law.

We may also suspend or terminate accounts where reasonably necessary to protect the security, integrity, or availability of the Service, other users, or our systems.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." MOOSS MAKES NO WARRANTY THAT:

• AI recommendations will be accurate, complete, or stylish.
• The Service will be uninterrupted or error-free.

Your use of the Service is at your sole risk. Mooss does not guarantee that any AI-generated recommendation, classification, styling suggestion, or other output will be accurate, appropriate, complete, or suitable for your individual preferences or circumstances.

11. Limitation of Liability

To the maximum extent permitted by law, Modascope Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Because the Service is provided free of charge, Modascope Inc.'s total liability for any claims under these terms shall not exceed fifty US dollars ($50).

12. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Delaware. Any disputes shall be resolved through binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association (AAA). You agree to waive the right to a jury trial or class action participation.

13. Customer Support Inquiries

When you reach out to our support or feedback channels within the application and voluntarily provide your email address, we collect and use that email address solely for the purpose of responding to your inquiry, troubleshooting, and resolving your reported issues. We do not use your support email address for marketing, advertising, or any other commercial purposes, and we do not sell or share it with third parties.
